Part II of the [[Environmental Protection Act 1990]] (EPA 90) contains the main regulatory controls regarding waste on land. It sets out the local authorities’ responsibilities to collect and arrange for the disposal of municipal waste and specifies the key offences of carrying out unlicensed waste management activities dealing with waste in a way, which harms human health or the environment.

The EPA 90 imposed a [[Duty of Care]] on waste producers and made further provisions in relation to [[Controlled Waste]] (s75). The waste management licensing regime introduced in the EPA 90 has since been phased out and is now regulated under the [[Environmental Permitting]] regime introduced in the [[Environmental Permitting (England and Wales) Regulations 2016]], as amended.

With regards to waste, the EPA 1990 replaced the provisions for waste in the Control of Pollution Act 1974 (CoPA 74) and provided a framework to increase the control over waste from ‘cradle to grave’. The Act and subsequent regulations brought about a change in the concept from waste disposal, as described in CoPA 74 to ‘waste management’. The new system aimed to bring about a fundamental change in the way wastes were disposed of with greater emphasis placed on techniques of waste management <ref>Defra, 2011. These regulations apply to development which is given planning permission under Part III of the Town and Country Planning Act 1990. <ref name="EIA" />

These regulations apply the amended EU Directive 2011/92/EC on the assessment of the effects of certain public and private projects on the environment (usually referred to as the ‘Environmental Impact Assessment Directive’) to the planning system in England<ref name="EIA" />.

==Overview of the Stages of an EIA==

There are five stages to an EIA:

The Environmental Statement must contain the information specified in regulation 18(3) and must meet the requirements of regulation 18(4). It must also include any additional information specified in Schedule 4 to the 2017 Regulations which is relevant to the specific characteristics of the particular development or type of development and to the environmental features likely to be significantly affected.

===Making a Planning Application and consultation===
the Environmental Statement (and the application for development to which it relates must be publicised electronically and by public notice. The Statutory 'consultation bodies' and the public must be given an opportunity to express their views about the proposed development and the Environmental Statement <ref name="EIA" />.

===Development covered by the Regulations===

The [[Environment Act 2021]] received Royal Assent on 9 November 2021 and set a new framework for environmental governance now that the UK has left the EU. Its aim is to tackle action to address environmental challenges including biodiversity loss, climate change, waste and pollution to the air, water and land.<ref name="LAW">[https://www.buckles-law.co.uk/blog/planning-and-environment/the-environment-act-2021-what-developers-landowners-and-lpas-need-to-know/]</ref>.

==Overview==
The Act will set statutory targets in four key areas, these targets must be of at least 15 years in duration and be proposed by late 2022<ref>ENDS</ref>:
*air quality
*biodiversity
*water
*[[waste]] and resource managment

The Act also creates a new [[Office for Environmental Protection]] ([[OEP]]) with a wide-ranging brief, including supervising the discharge of environmental duties by the government and other public authorities<ref name= "LAW" />. This includes powers to investigate alleged breaches of environmental law by public bodies, to issue its own non-binding rulings on alleged breaches and (in effect) to apply to enforce that ruling through the Courts by way of an 'Environmental Review'<ref name="LAW"/>.

The Act implements the Government's ambitions for improving the natural [[environment]] which were previously set out in the [[25- Year Environment Plan]]. The [[Environment Bill]] required the government to publish an Environmental Improvement Plan (EIP) and the government has pledged to set interim targets for each five-year period and lay out steps it intends to take to improve the natural environment. The [[25- Year Environment Plan]] will be adopted as the first EIP. The [[OEP]] is intended to hold the government to account for meeting these targets<ref>ENDS</ref>.

The Act applies across the UK, however parts of it only apply to one or more jusridiction<ref name="COM">[https://thecompliancepeople.co.uk/updates/legal/the-environment-act-2021/ The Compliance People]</ref>.

==Legal Framework<ref name="COM" />==

The first part of the Act puts duties on the Government in relation to environmental governance. This includes requiring the Government to:
*put in place measures to allow the Government to set and meet long-term targets related to the natural environment and people’s enjoyment of the environment;
*set at least one long-term target each related to priority areas of air, water, biodiversity, resource efficiency and waste by October 2022;
*set and meet an air quality target for fine particulate matter;
*set and meet a target related to the abundance of species;
*put in place the processes for setting and amending long-term targets
*have an Environmental Improvement Plan containing steps it intends to take to improve the natural environment. The plan must be for at least 15 years. The [[25- Year Environment Plan]]‘A Green Future: Our 25 Year Plan to Improve the Environment‘ published by the Government in 2018 can be treated as such a plan; and
*collect and publish data related to measuring progress for improving the natural environment and meeting targets.

==Targets==
In March 2022 the [[DEFRA|Government]] published a consultation seeking views on new targets under the [[Environment Act 2021]] with the aim of improving the natural environment.

The finalised targets (and the legislation which enacts them) are listed within the individual categories below:

===Air Quality===
The Environmental Targets (Fine Particulate Matter) (England) Regulations 2023 state that<ref>https://www.legislation.gov.uk/uksi/2023/96/regulation/4/made</ref>:

* by the end of 31st December 2040 the annual mean level of PM2.5 in ambient air must be equal to or less than 10 μg/m3.
*by the end of 31st December 2040 the population exposure reduction target is at least a 35% reduction with the average population exposure in the three year period from 1st January 2016 to 31st December 2018 (baseline period)

===Biodiversity===
The Environmental Targets (Biodiversity) (England) Regulations 2023 state that<ref>https://www.legislation.gov.uk/uksi/2023/91/regulation/4/made</ref>:
*Reduce the risk of species' extinction by 2042, when compared to the risk of species extinction in 2022 (Species' Extinction target).
*The overall relative species' abundance index on 31st December 2030 indicates that the decline in the abundances of species has been halted.
*By 31st Dcember 2042 the overall relative species abundance index is higher than the overall relative species abundance index for 31st December 2022 and at least 10% higher than the overall relative species abundance index for 31st Decemember 2030 (Species' Abundance target).
*Improve the England-level GB Red List Index of Species extinction risk by 2042, compared to 2022 levels (Exctinction risk of native species - Red List Index target)
*Create or restore in excess of 500,000 hectares of a range of wildlife-rich habitat outside protected sites by 31st December 2042, compared to 2022 levels (Wider Habitats target)
*70% of the designated features in the Marine Protected Area (MPA) network to be in favourable condition by 2042, with the remainder in recovering condition, and additional reporting on changes in individual feature condition (Marine Protection target).
*Increase tree canopy and woodland cover from 14.5% to 17.5% of total land area in England by 2050 (Woodland Cover target).

===Waste===
The Environmental Targets (Residual Waste) (England) Regulations 2023 state that<ref>https://www.legislation.gov.uk/uksi/2023/92/regulation/2/made</ref>:
*the residual waste long term target is that by the end of 31st December 2042 the total mass of residual waste for the calendar year 2042 does not exceed 287 kilograms per head of population in England.
**"residual waste" means any waste, other than excluded waste which originated in England and is treated by a method specified below:
***sent to landfill in the UK
***put through incineration in the UK
***used in energy recovery in the UK; or
***sent outside the UK for energy recovery

===Water===
The Environmental Targets (Water) (England) Regulations 2023<ref>https://www.legislation.gov.uk/uksi/2023/93/regulation/5/made</ref> state that:
*By the 31st Dcember 2038 the length of rivers and estuaries polluted by target susbstances (cadmium, nickel, lead, copper, zinc, arsenic) from abandoned metal mines must beat least 50% lower than the 2022 baseline. (Abandoned metal mines target)
*By the 31st Decemebr 2038 the total nitrogen, total phosphorus and sediment pollution load from agriculture to the water environment must be at least 40% lower than the 2018 baseline (Agriculture target)
*By 31st December 2038, the total phosphorous load discharged into freshwaters from relevant wastewater/sewage discharges must be at least 80% lower than the 2020 baseline (Wastewater target)
*By 31st December 2038 the volume of potable water supplied per day per head of population in England is at least 20% lower than the 1st April 2019 to 31st March 2020 baseline.

==Part 3 of the Environment Act 2021 - Waste and Resource Efficiency<ref name="COM" />==

Part 3 of the Act relates to resource and waste efficiency.

===Producer Responsibility===
The Act allows Ministers in England and the Devolved Administrations to make regulations about [[Producer Responsibility|producer responsibility obligations]] which could be made to prevent a product or material becoming [[waste]], reduce the amount of a product or material that becomes [[waste]], or sustain a minimum level of [[reuse]], redistribution, [[recovery]] or [[recycling]] of products or materials. Further detail on this can be found in Schedule 4<ref name="COM" />.

Regulations can also be made that require payments from those involved in the manufacturing, processing, distributing or supplying of specific products or materials to contribute to the [[disposal]] costs of those products or materials. Requirements about what these regulations must or may include is given in Schedule 5.

Manufacturers and producers may also be required through subsequent legislation to provide information about the resource efficiency of their products. Detail of what may be required is given in Schedule 6. Schedule 7 gives detail on what regulations may require in relation to durability, reparability and recyclability of products <ref name="COM" />.

===[[Deposit Return Scheme|Deposit Schemes]]===
The Act allows Ministers in England and the Devolved Administrations to make regulations about [[Deposit Return Scheme|deposit schemes]]. These may require a person supplied with an item to pay a deposit which is refunded when that item is collected (e.g. a deposit paid on a drinks bottle that is refunded when the drink is consumed and the bottle returned). Schedule 8 gives detail on these schemes<ref name="COM" />.

===Single Use Items===
The Ministers of England and the Develoved Administrations may make regulations requiring sellers of goods or services to charge for single use items. The goods this will apply to and how it will operate will be specified in subsequent legislation. Schedule 9 gives detail on charges for single use items<ref name="COM" />.

===Separation of [[Waste]]===

The [[Environment Act 2021]] received Royal Assent on 9 November 2021 and sets a new framework for environmental governance now that the UK has left the EU. Its aim is to tackle action to address environmental challenges including biodiversity loss, climate change, waste and pollution to the air, water and land.<ref name="LAW">[https://www.buckles-law.co.uk/blog/planning-and-environment/the-environment-act-2021-what-developers-landowners-and-lpas-need-to-know/]</ref>.

==Overview==
The Act will set statutory targets in four key areas, these targets must be of at least 15 years in duration and be proposed by late 2022<ref>ENDS</ref>:
*air quality
*biodiversity
*water
*[[waste]] and resource managment

The Act also creates a new [[Office for Environmental Protection]] ([[OEP]]) with a wide-ranging brief, including supervising the discharge of environmental duties by the government and other public authorities<ref name= "LAW" />. This includes powers to investigate alleged breaches of environmental law by public bodies, to issue its own non-binding rulings on alleged breaches and (in effect) to apply to enforce that ruling through the Courts by way of an 'Environmental Review'<ref name="LAW"/>.

The Act implements the Government's ambitions for improving the natural [[environment]] which were previously set out in the [[25- Year Environment Plan]]. The [[Environment Bill]] required the government to publish an Environmental Improvement Plan (EIP) and the government has pledged to set interim targets for each five-year period and lay out steps it intends to take to improve the natural environment. The [[25- Year Environment Plan]] will be adopted as the first EIP. The [[OEP]] is intended to hold the government to account for meeting these targets<ref>ENDS</ref>.

The first part of the Act puts duties on the Government in relation to environmental governance. This includes requiring the Government to:
*put in place measures to allow the Government to set and meet long-term targets related to the natural environment and people’s enjoyment of the environment;
*set at least one long-term target each related to priority areas of air, water, biodiversity, resource efficiency and waste by October 2022;
*set and meet an air quality target for fine particulate matter;
*set and meet a target related to the abundance of species;
*put in place the processes for setting and amending long-term targets
*have an Environmental Improvement Plan containing steps it intends to take to improve the natural environment. The plan must be for at least 15 years. The [[25- Year Environment Plan]]‘A Green Future: Our 25 Year Plan to Improve the Environment‘ published by the Government in 2018 can be treated as such a plan; and
*collect and publish data related to measuring progress for improving the natural environment and meeting targets.

==Targets==
In March 2022 the [[DEFRA|Government]] published a consultation seeking views on new targets under the [[Environment Act 2021]] with the aim of improving the natural environment.

===Air Quality===
The Environmental Targets (Fine Particulate Matter) (England) Regulations 2023 state that<ref>https://www.legislation.gov.uk/uksi/2023/96/regulation/4/made</ref>:

* by the end of 31st December 2040 the annual mean level of PM2.5 in ambient air must be equal to or less than 10 μg/m3.
*by the end of 31st December 2040 the population exposure reduction target is at least a 35% reduction with the average population exposure in the three year period from 1st January 2016 to 31st December 2018 (baseline period)

===Biodiversity===
The Environmental Targets (Biodiversity) (England) Regulations 2023 state that<ref>https://www.legislation.gov.uk/uksi/2023/91/regulation/4/made</ref>:
*Reduce the risk of species' extinction by 2042, when compared to the risk of species extinction in 2022 (Species' Extinction target).
*The overall relative species' abundance index on 31st December 2030 indicates that the decline in the abundances of species has been halted.
*By 31st Dcember 2042 the overall relative species abundance index is higher than the overall relative species abundance index for 31st December 2022 and at least 10% higher than the overall relative species abundance index for 31st Decemember 2030 (Species' Abundance target).
*Improve the England-level GB Red List Index of Species extinction risk by 2042, compared to 2022 levels (Exctinction risk of native species - Red List Index target)
*Create or restore in excess of 500,000 hectares of a range of wildlife-rich habitat outside protected sites by 31st December 2042, compared to 2022 levels (Wider Habitats target)
*70% of the designated features in the Marine Protected Area (MPA) network to be in favourable condition by 2042, with the remainder in recovering condition, and additional reporting on changes in individual feature condition (Marine Protection target).
*Increase tree canopy and woodland cover from 14.5% to 17.5% of total land area in England by 2050 (Woodland Cover target).

The Environmental Targets (Residual Waste) (England) Regulations 2023 state that<ref>https://www.legislation.gov.uk/uksi/2023/92/regulation/2/made</ref>:
*the residual waste long term target is that by the end of 31st December 2042 the total mass of residual waste for the calendar year 2042 does not exceed 287 kilograms per head of population in England.

The Environmental Targets (Water) (England) Regulations 2023<ref>https://www.legislation.gov.uk/uksi/2023/93/regulation/5/made</ref> state that:
*By the 31st Dcember 2038 the length of rivers and estuaries polluted by target susbstances (cadmium, nickel, lead, copper, zinc, arsenic) from abandoned metal mines must beat least 50% lower than the 2022 baseline. (Abandoned metal mines target)
*By the 31st Decemebr 2038 the total nitrogen, total phosphorus and sediment pollution load from agriculture to the water environment must be at least 40% lower than the 2018 baseline (Agriculture target)
*By 31st December 2038, the total phosphorous load discharged into freshwaters from relevant wastewater/sewage discharges must be at least 80% lower than the 2020 baseline (Wastewater target)
*By 31st December 2038 the volume of potable water supplied per day per head of population in England is at least 20% lower than the 1st April 2019 to 31st March 2020 baseline.

Part 3 of the Act relates to resource and waste efficiency.

===Producer Responsibility===
The Act allows Ministers in England and the Devolved Administrations to make regulations about [[Producer Responsibility|producer responsibility obligations]] which could be made to prevent a product or material becoming [[waste]], reduce the amount of a product or material that becomes [[waste]], or sustain a minimum level of [[reuse]], redistribution, [[recovery]] or [[recycling]] of products or materials. Further detail on this can be found in Schedule 4<ref name="COM" />.

Regulations can also be made that require payments from those involved in the manufacturing, processing, distributing or supplying of specific products or materials to contribute to the [[disposal]] costs of those products or materials. Requirements about what these regulations must or may include is given in Schedule 5.

Manufacturers and producers may also be required through subsequent legislation to provide information about the resource efficiency of their products. Detail of what may be required is given in Schedule 6. Schedule 7 gives detail on what regulations may require in relation to durability, reparability and recyclability of products <ref name="COM" />.

The [[Environment Act 2021]] received Royal Assent on 9 November 2021 and sets a new framework for environmental governance now that the UK has left the EU. Its aim is to tackle action to address environmental challenges including biodiversity loss, climate change, waste and pollution to the air, water and land.<ref name="LAW">[https://www.buckles-law.co.uk/blog/planning-and-environment/the-environment-act-2021-what-developers-landowners-and-lpas-need-to-know/]</ref>.

==Overview==
The Act will set statutory targets in four key areas, these targets must be of at least 15 years in duration and be proposed by late 2022<ref>ENDS</ref>:
*air quality
*biodiversity
*water
*[[waste]] and resource managment

The Act also creates a new [[Office for Environmental Protection]] ([[OEP]]) with a wide-ranging brief, including supervising the discharge of environmental duties by the government and other public authorities<ref name= "LAW" />. This includes powers to investigate alleged breaches of environmental law by public bodies, to issue its own non-binding rulings on alleged breaches and (in effect) to apply to enforce that ruling through the Courts by way of an 'Environmental Review'<ref name="LAW"/>.

The Act implements the Government's ambitions for improving the natural [[environment]] which were previously set out in the [[25- Year Environment Plan]]. The [[Environment Bill]] required the government to publish an Environmental Improvement Plan (EIP) and the government has pledged to set interim targets for each five-year period and lay out steps it intends to take to improve the natural environment. The [[25- Year Environment Plan]] will be adopted as the first EIP. The [[OEP]] is intended to hold the government to account for meeting these targets<ref>ENDS</ref>.

==Legal Framework<ref name="COM" />==

The first part of the Act puts duties on the Government in relation to environmental governance. This includes requiring the Government to:
*put in place measures to allow the Government to set and meet long-term targets related to the natural environment and people’s enjoyment of the environment;
*set at least one long-term target each related to priority areas of air, water, biodiversity, resource efficiency and waste by October 2022;
*set and meet an air quality target for fine particulate matter;
*set and meet a target related to the abundance of species;
*put in place the processes for setting and amending long-term targets
*have an Environmental Improvement Plan containing steps it intends to take to improve the natural environment. The plan must be for at least 15 years. The [[25- Year Environment Plan]]‘A Green Future: Our 25 Year Plan to Improve the Environment‘ published by the Government in 2018 can be treated as such a plan; and
*collect and publish data related to measuring progress for improving the natural environment and meeting targets.

==Targets==
In March 2022 the [[DEFRA|Government]] published a consultation seeking views on new targets under the [[Environment Act 2021]] with the aim of improving the natural environment.

The finalised targets (and the legislation which enacts them) are listed within the individual categories below:

===Air Quality===
The Environmental Targets (Fine Particulate Matter) (England) Regulations 2023 state that<ref>https://www.legislation.gov.uk/uksi/2023/96/regulation/4/made</ref>:

* by the end of 31st December 2040 the annual mean level of PM2.5 in ambient air must be equal to or less than 10 μg/m3.
*by the end of 31st December 2040 the population exposure reduction target is at least a 35% reduction with the average population exposure in the three year period from 1st January 2016 to 31st December 2018 (baseline period)

===Biodiversity===
*Halt the decline in species by 2030 (Species abundance target); and then
*Increase species abundance by at least 10% by 2042 compared to 2030 levels.
*Improve the England-level GB Red List Index of Species extinction risk by 2042, compared to 2022 levels (Exctinction risk of native species - Red List Index target)
*Create or restore in excess of 500,000 hectares of a range of wildlife-rich habitat outside protected sites by 2042, compared to 2022 levels (Wider Habitats target)
*70% of the designated features in the Marine Protected Area (MPA) network to be in favourable condition by 2042, with the remainder in recovering condition, and additional reporting on changes in individual feature condition (Marine Protection target).
*Increase tree canopy and woodland cover from 14.5% to 17.5% of total land area in England by 2050 (Woodland Cover target).

===Waste===
The Environmental Targets (Residual Waste) (England) Regulations 2023 state that<ref>https://www.legislation.gov.uk/uksi/2023/92/regulation/2/made</ref>:
*the residual waste long term target is that by the end of 31st December 2042 the total mass of residual waste for the calendar year 2042 does not exceed 287 kilograms per head of population in England.
**"residual waste" means any waste, other than excluded waste which originated in England and is treated by a method specified below:
***sent to landfill in the UK
***put through incineration in the UK
***used in energy recovery in the UK; or
***sent outside the UK for energy recovery

===Water===
The Environmental Targets (Water) (England) Regulations 2023<ref>https://www.legislation.gov.uk/uksi/2023/93/regulation/5/made</ref> state that:
*By the 31st Dcember 2038 the length of rivers and estuaries polluted by target susbstances (cadmium, nickel, lead, copper, zinc, arsenic) from abandoned metal mines must beat least 50% lower than the 2022 baseline. (Abandoned metal mines target)
*By the 31st Decemebr 2038 the total nitrogen, total phosphorus and sediment pollution load from agriculture to the water environment must be at least 40% lower than the 2018 baseline (Agriculture target)
*By 31st December 2038, the total phosphorous load discharged into freshwaters from relevant wastewater/sewage discharges must be at least 80% lower than the 2020 baseline (Wastewater target)
*By 31st December 2038 the volume of potable water supplied per day per head of population in England is at least 20% lower than the 1st April 2019 to 31st March 2020 baseline.

Part 3 of the Act relates to resource and waste efficiency.

===Producer Responsibility===
The Act allows Ministers in England and the Devolved Administrations to make regulations about [[Producer Responsibility|producer responsibility obligations]] which could be made to prevent a product or material becoming [[waste]], reduce the amount of a product or material that becomes [[waste]], or sustain a minimum level of [[reuse]], redistribution, [[recovery]] or [[recycling]] of products or materials. Further detail on this can be found in Schedule 4<ref name="COM" />.

Regulations can also be made that require payments from those involved in the manufacturing, processing, distributing or supplying of specific products or materials to contribute to the [[disposal]] costs of those products or materials. Requirements about what these regulations must or may include is given in Schedule 5.

Manufacturers and producers may also be required through subsequent legislation to provide information about the resource efficiency of their products. Detail of what may be required is given in Schedule 6. Schedule 7 gives detail on what regulations may require in relation to durability, reparability and recyclability of products <ref name="COM" />.
